HOSTING TERMS OF SERVICE

AGREEMENT TO OUR HOSTING SERVICES

INTRODUCTION

Welcome to WebSocle website!

This is an agreement between us, our, we, WEBSOCLE LLC, and you, your, client, in connection with the Hosting Services available on the official website https://www.websocle.com. This Agreement is designed to be clear and easy to understand and is in no way a substitute for our GENERAL TERMS OF SERVICES.

By using this website to purchase one or several hosting package(s), you acknowledge that you have read, understood and agree to be bound by the Hosting Terms of Service set forth herein. If you do not agree to all of these Terms and Conditions, you are prohibited from purchasing one or several hosting package(s) and you may discontinue use immediately. We recommend that you save or print a copy of these Hosting Terms of Service for future reference.

The Hosting Terms outline the conditions, rules and regulations governing your use of our Hosting Services located at https://www.websocle.com, and apply in full force and effect to your purchase of one or several hosting package(s), and use of this Website constitutes express agreement to all Terms and Conditions contained on this Website in their entirety. Do not continue to use this Website if you have any objection to any of its Terms and Conditions.

 

IF YOU DO NOT AGREE WITH ALL OF THESE HOSTING TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM PURCHASING A HOSTING PACKAGE AND YOU MAY DISCONTINUE USE IMMEDIATELY.

Supplemental Terms and Conditions or Documents that may be posted on the Hosting Services from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Legal Hosting Terms at any time and for any reason. We will alert you about any changes by updating the "Last updated" date of these Hosting Terms, and you waive any right to receive specific notice of each such change.

It is your responsibility to periodically review these Hosting Terms to stay informed of updates. You will be subject to and will be deemed to have been made aware of and to have accepted the changes in any revised Hosting Terms by your continued use of the Hosting Services after the date such revised Hosting Terms are posted.

We recommend that you print a copy of these Hosting Terms for your records.

SHARED AND RESELLER HOSTING

All purchases that the client may make for accessing our Shared and Reseller Hosting Services will be governed by these Hosting Terms, and we will require the client to accept these Terms before providing such services to the client.

  1. Definitions

1.1. Charge: The amount specified on the pricing page or in the package order form, and such amount agreed by the client to access our Hosting Services.

1.2. Agreement: Your purchases and use of Services made under these Hosting Terms and Conditions between you and us.

1.3. Effective Date: The date upon which the client completes and submits the online hosting package form, and we send to the client an invoice receipt for confirmation, and the client starts using the service on that day.

1.4. Minimum Term: The minimum of 12 months beginning on the effective date when you purchased a hosting package till the day it set to expire.

1.5. Refund: The client has a 30-day refund guarantee from the effective date to request a refund for a hosting package already purchased, and no refund request will be considered after that date.

1.6. Acceptance Policy: By using our Hosting Services, you agree to be bound by the Hosting Terms set forth herein and WebSocle’s GENERAL TERMS OF SERVICES.

1.7. Warranties: We provide the client with reasonably efficient Hosting Services in accordance with the standards reasonably expected from leading services providers in the hosting industry.

1.8. Hosting Backup: We perform backup sessions of our directories regularly without considering a specific account, in fact, the client should proceed to the purchase of a backup plan for un additional fee to backup his/her site(s), files, and so on.

2. Service Uptime

We guarantee a full-time uptime Hosting Service, but it does not apply to service interruptions caused by: (1) periodic scheduled maintenance or repairs we may undertake from time to time; (2) outages related to the reliability of certain programming environments, and (3) any criteria or event in WebSocle’s GENERAL TERMS OF SERVICES.

3. Third-Party Software

3.1. We provide some third-party software to the client for account management and feature-rich service, but we do not guarantee that any specific results can be obtained by using such software. We do not take any responsibility for the proper functioning of the software.

3.2. By using our Hosting Services that include third-party software, you agree to the relevant third-party Terms of Service and that you shall use the Services in accordance with such Terms and our Hosting Terms set forth herein.

3.3. If the third-party software is accompanied by or requires a license agreement from the third-party provider, your use of the software is subject to that license agreement, in addition to our Hosting Terms set forth herein.

3.4. WebSocle does not have a refund policy for third-party software licenses. In point of fact, if you purchase a third-party software license from us, no refund request will be considered.

3.5. We don’t control any third-party software and therefore we are not responsible for any third-party software performance, and we don’t guarantee any results from third-party software. In fact, we will not be liable or responsible for any damage or loss occurring in connection with third party software.

3.6. We reserve the right to modify, change, or discontinue any third-party software at any time, and the client agrees to cooperate in performing such steps as may be necessary to transform and/or update our system, and to install any updates to the third-party software.

4. Server Migration

To provide an up-to-date service to clients, to have redesigned our infrastructures, or for any reason, it may be important to migrate our servers, therefore the client accepts that another IP number may be assigned to him or her at any time, even in the case of a dedicated IP number.

5. Cancellation or Termination

This agreement may be terminated by the client in his or her account if enabled or by submitting a ticket under the Sales Department category or by WebSocle for no reason or any reason in its GENERAL TERMS OF SERVICES.

6. Client Support

6.1. We provide client support only for issues related to our Service(s) at no additional fee, in point of fact, it remains at our sole discretion to decide what is an issue related or not related to our Service(s).

6.2. We may refuse to provide support for issues unrelated to our Service(s) just as we may provide support for issues unrelated to our Service(s) for additional non-refundable fee(s).

6.3. WebSocle has only two channels to provide client support: Live Chat and Ticket, in point of fact, no other channel will be considered except one of these two.

6.4. By requesting our support for any reason, you agree to provide us with the required information and accept and authorize us to access your account for related operation(s).

6.5. You agree to have backed up your data, files, etc., before requesting our support, and agree that WebSocle is in no way liable and accountable to any incident that may occur and you will be responsible for restoring the backup copies of your data, files, etc., by yourself.

6.6. By requesting our support, you accept our Ethics Policy.
