AGREEMENT TO OUR DOMAIN REGISTRATION SERVICES
INTRODUCTION

This is an agreement or policy between us, our, we, WEBSOCLE LLC, and you, your, client, in connection with the domain name registration service available on the official website https://www.websocle.com. This Policy is designed to be clear and easy to understand and is in no way a substitute for our GENERAL TERMS OF SERVICES.
By using this Website to register one or several domain name(s), you acknowledge that you have read, understood and agreed to be bound by the Domain Name Registration Policy set forth herein. If you do not agree to all these Terms and Conditions, you are prohibited from registering one or several domain name(s) and you may discontinue use immediately. We recommend that you save or print a copy of this Policy for future reference.
The Domain Name Registration Policy outlines the conditions, rules and regulations governing your use of our Domain Name Registration Services located at https://www.websocle.com, and apply in full force and effect to your registration of one or several domain name(s), and use of this Website constitutes express agreement to all Terms and Conditions contained on this Website in their entirety. Do not continue to use this Website if you have any objection to any of its Terms and Conditions.
IF YOU DO NOT AGREE WITH ALL OF THESE DOMAIN NAME REGISTRATION TERMS AND CONDITIONS, THEN YOU ARE EXPRESSLY PROHIBITED FROM REGISTERING A DOMAIN NAME AND YOU MAY DISCONTINUE USE IMMEDIATELY.
Supplemental Terms and Conditions or Documents that may be posted on the Domain Name Registration Services from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Legal Domain Name Registration Terms at any time and for any reason. We will alert you about any changes by updating the "Last updated" date of this Domain Name Registration Policy, and you waive any right to receive specific notice of each such change.
It is your responsibility to periodically review this Domain Name Registration Policy to stay informed of updated. You will be subject to and will be deemed to have been made aware of and to have accepted the changes in any revised Domain Name Registration Policy by your continued use of the Domain Name Registration Services after the date such revised Domain Name Registration Policy is posted.
We recommend that you print a copy of this Policy for your records.
By using the Service, you agree to all Terms and Conditions of this Agreement; WebSocle's General Terms of Services; Enom’s Registration Agreement; ICANN Policies, as published from time to time at icann.org; any rules, agreements, or policies of any registry of a relevant top-level domain name; the UDRP (Uniform Domain-Name Dispute-Resolution Policy); the URS (Uniform Rapid Suspension); and any rules, policies, or agreements of any relevant government.
You explicitly agree that violation of or refusal to comply with any ICANN policy is a violation of this Agreement and may result in immediate termination of this Agreement.
2. Rights and Responsibilities
ICANN (Internet Corporation for Assigned Names and Numbers) has dedicated a web page to list the rights and responsibilities of domain name(s) registrants. To know your rights and responsibilities, you can consult ICANN’s Registrants' Benefits and Responsibilities web page.
3. Contact Information and Domain Name Whois Information
3.1. With regards to the Service, you agree to provide certain current, complete and accurate information about you, both with respect to your account information and with respect to the WHOIS information for your domain name(s) registered. You acknowledge to maintain and update this information as needed to keep it current, complete and accurate in connection with your client account.
Based on the domain registration, you may require submitting the administrative, technical, and billing contacts for your domain name registration(s) that may include name, postal and billing addresses, email address, telephone number, and fax number.
3.2. You acknowledge and agree that domain name registration requires that the contact information, in whole or in part, be shared with the registry operator. As required by ICANN, this information may also be required to be made publicly available by means of Whois and/or the registry operator. Besides, you acknowledge and agree that certain registries require this information be made publicly available even to those residents in the EEA who are subject to GDPR.
3.3. We provide nameservers free services to clients, if you choose not to use our nameservers, you may provide information regarding your nameservers for your domain name(s). Therefore, if you purchase Registration Only Services, we may supply this information and point your domain name to a website of our choosing until such time as you elect to supply the nameservers information or until such time as you elect to upgrade from Registration Only Services.
4. Duties, Representative, and Whois Contact Information
4.1. In registering domain name(s), you provide information about or on behalf of a third party, you represent and warrant that you have provided notice to that third party of the disclosure and use of that party’s information as set forth in this Policy, and obtained the third party’s express written consent to the disclosure and use of that party’s information as set forth in this Policy. You agree to provide this express written consent upon request.
4.2. You are responsible for regularly monitoring emails sent to the email address you used to register your domain name(s). You may lose your rights to the domain name(s) in question if you do not respond appropriately and timely to an email sent in conjunction therewith.
BY DEFAULT, WEBSOCLE PROVIDES WHOIS PRIVACY PROTECTION TO THE REGISTRANTS, WHICH PROTECTION INCLUDES REGISTRANT, ADMINISTRATIVE AND TECHNICAL CONTACTS. IF YOU MANAGE A DOMAIN WHERE THERE IS THIRD PARTY INFORMATION IN WHOIS AND/OR YOU ARE A REGISTRANT WHO HAS THIRD PARTIES AS ADMINISTRATIVE/TECHNICAL CONTACTS, YOU UNDERSTAND AND AGREE THAT YOU ARE AUTHORIZED BY THOSE THIRD PARTIES TO PROVIDE EXPLICIT CONSENT ON THEIR BEHALF. IN ADDITION, YOU ACKNOWLEDGE THAT WHEN YOU DISABLE WHOIS PRIVACY SERVICE YOU ARE PROVIDING EXPLICIT CONSENT ON BEHALF OF ALL CONTACTS LISTED IN THE RELEVANT WHOIS TO PUBLICLY SHARE THEIR PERSONAL IDENTIFIABLE INFORMATION (PII). IN ADDITION, AS IT RELATES TO THE GDPR, YOU ACKNOWLEDGE THAT YOU ARE THE CONTROLLER REGARDING THIS ACTION AND RESPONSIBLE FOR ANY RELATED AND REQUIRED CONSENTS.
5. Data Sharing
5.1. Information required for domain name registration varies by top-level domain. That information known as Minimum Information is necessary at the time of the domain registration or renewal. The Minimum Information will be shared with WebSocle, Enom and may be shared with the relevant authoritative registry services provider for your top-level domain, TLD. The identity of the authoritative registry services provider can be found at org/whois.
5.2. Domain name registration information provided or that we otherwise maintain will be made available to the following parties: ICANN, and any ICANN-authorized escrow service, the registry administrator(s), and to other third parties as ICANN and applicable laws may require or permit (including through web-based and other online whois lookup systems), whether during or after the term of your Services of the domain name.
You irrevocably waive all claims and causes of action you may have arising from such disclosure or use of such information. We may make publicly available or directly available to third parties some or all the information you provide, for purposes of inspection (such as through our whois service) or for targeted marketing and other purposes as required or permitted by applicable laws, including by way of bulk whois data access provided to third parties who enter into a bulk whois data access agreement with us.
6. Domain Name Registration Services
We are not an ICANN accredited registrar, and as we are working on our accreditation with ICANN, we partner with Enom to be able to make available the Domain Name Registration Services. We provide clients with a range of domain names for registration, including generic top-level domains, gTLDs, and country code top-level domains, ccTLDs. 6.1. Definitions
6.1.1. Charge: The amount specified on the pricing page or order form, and such amount agreed by the client to register one or several domain name(s).
6.1.2. Effective Date: The date upon which the client completes and submits the online domain name registration order form, and we send to the client an invoice receipt for confirmation, and the service starts immediately taking effect on that day.
6.1.3. Refund: For the domain name registration, all fees are non-refundable, in whole or in part, even if client’s domain name registration is suspended, cancelled, or transferred prior to the end of the then-current registration term. Enom has not a refund policy, thus in no case can WebSocle make a refund for the client.
6.1.4. Minimum Term: The minimum of 12 months beginning on the effective date when the client registers a domain name till the day that domain set to expire.
6.1.5. Agreement: Your domain name(s) registration and use of Services made under this Policy between you and us.
7. Domain Expiration and Renewal
Regarding domain name registration services, we will email a renewal notification approximately one month then two times again prior to each such domain name’s expiration. In addition, if a domain name is not renewed, we will email three additional renewal notifications within one month after the expiration of such domain name’s registration. All renewal notifications will be sent to the primary contact for domain name registered.
8. Domain Expiration and Reactivation
After expiration of the term of domain name registration services, we assume no responsibility for the domain. In point of fact:
8.1. We may, in our sole discretion, choose not to offer a reactivation period and we shall not be liable.
8.2. The reactivation period renewal should be thirty (30) days after expiration of the term, if any, and the process may involve additional fees, which may be determined by both us and the registry related to such reactivation.
8.3. We may make expired domain name service(s) available to third parties, and we may auction off the rights to expired domain name services, and that auction should begin after the end of the reactivation period, and/or expired domain name registration services may be re-registered to any party at any time.
9. Domain(s) Transfer
9.1. Transfer of your domain name(s) services shall be governed by ICANN’s transfer policy, including the Registrar Transfer Dispute Resolution Policy, as well as the UDRP and URS, as these policies may be modified from time to time.
9.2. To transfer your domain name(s), you should first login to your account to lock or unlock your domain name(s) and/or to obtain the EPP “authcode” which is required to transfer domain services in an EPP registry (such as .com). Alternatively, you should contact us to have your domain name(s) services locked or unlocked or to obtain the EPP “authcode.
9.3. Only the registrant listed in the whois information may approve or deny a transfer request. Without limitation, domain name services may not be transferred within sixty (60) days of initial registration, within sixty (60) days of a transfer, if there is a dispute.
9.4. Transfer requests typically take five (5) business days to be processed. A transfer will not be processed if, during that time, the domain name registration services expire, in which event you may need to reinstate the transfer.
9.5. You may be required to resubmit a transfer request if there is a communication failure or other problem at either our end or at the registry. YOU ASSUME ALL RISK FOR FAILURE OF A TRANSFER WHETHER OR NOT THE TRANSFER PROCESS IS INITIATED CLOSE TO THE END OF A REGISTRATION TERM.
10. Domain Support Service
10.1. WebSocle has only two channels to provide client support: Live Chat and Ticket; in point of fact, no other channel will be considered except one of these two.
10.2. Although domain name registration is an automatic mechanism, we provide support service to registered domain issues at no cost.
10.3. By requesting our support for registered domain issues, which sometimes require us to access your account or server, you also agree to our Hosting Terms of Service.
